We let the apples fall all through September, and we left them precisely where they landed, hundreds of them, carpeting the grass beneath the overhanging branches. Warren watched from his side, growing more agitated by the day, because a lawn full of rotting fruit draws wasps, and the smell drifts, and it was drifting straight back toward his own patio. He came to the fence to complain, to demand we clean up “his” apples. Grant walked out, calm as ever, and handed him a copy of the property statute along with the lawyer’s letter. “They’re not your apples, Warren,” he said. “They fell on our land, so they’re ours, same as the law says. We’ll dispose of our property however we like. And since you brought it up, your branches are still hanging over our fence and one of your apples already stained our shed. So we have some things to discuss.”<\/p>\n
The color drained from Warren’s face as he read. He had spent years operating on the assumption that the tree gave him authority over our entire yard, and he had built his cruelty on a rule that was the exact opposite of the truth. Grant offered him a choice, the same way you offer a choice to someone who has finally lost his footing. Warren could hire an arborist to properly trim every branch back to the property line, at his own cost, and pay to repaint our stained shed, and in exchange we would keep the matter neighborly and private. Or Warren could refuse, and we would exercise our legal right to trim the branches ourselves and pursue the shed damage through small claims, with two photographs of him making children hand over their own apples as a lovely opening exhibit.<\/p>\n
Warren chose the arborist. Of course he did. Within two weeks, every overhanging branch was gone, trimmed clean to the property line, and no apple has fallen in our yard since. He repainted our shed himself, badly, but he did it, and the stain from two years ago is finally gone. He has not spoken a cruel word to my children since the day he read that letter, because he understands now that the family next door knows the law better than he does, and documents everything.<\/p>\n
But the part that mattered most had nothing to do with branches or paint. That night, after the apples, Grant sat both kids down and told them the truth in words they could understand. That the mean man at the fence had been wrong, that the apples in our yard had always belonged to them, and that they had done nothing wrong by having them. He told Felix, whose ears had turned so red, that being polite to a grown-up is good, but that no adult has the right to make you feel like a thief in your own backyard. Ivy asked if she was still a good girl. Grant told her she was the best, and that a man who yells at children over apples is the one who should be ashamed, not her. They believed him, because he is their father, and because he made it right. The apples were never really the point. My husband did not just win an argument with a neighbor.
